Michael Jordan Tells Court He Felt No Fear of Nascar in Legal Battle

Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, stated that his drive to win and novelty within the sport motivated his push for 23XI Racing to confront Nascar over alleged violations of competition laws.

Financial Stakes and a Competitive Drive

The owner disclosed financial and corporate details of his 23XI team, revealing he put in $40 million of his personal wealth into the Nascar Cup series team co-founded with partner Polk and driver Hamlin.

“Someone had to step forward,” Jordan said in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I felt I could challenge Nascar in its entirety. From my perspective, the sport it needed to be looked at from a different view.”

Central Issue: Charter Agreements and Contract Pressure

At issue is the expiration of a 2016 deal where Nascar provided each team a “charter”. The concept is similar to other major leagues with separately owned franchises, like the NBA’s Hornets or the Carolina Panthers. This deal was set to expire in 2024 when Nascar demanded charter membership renewals.

Jordan testified for about sixty minutes and left the court to pandemonium, with fans and media clamoring for a view or a picture of the global icon.

Leading the Legal Charge

23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to change a operating model Jordan contended is unlawful to maintain excessive control.

For Jordan and and Heather Gibbs, who testified before Jordan, are events from September 2024. She recounted a hectic and tense six hours where the racing circuit told teams they had to sign a charter agreement extension. Choosing Litigation

Jordan said that his team and its ally concluded their sole viable path was to decline to sign that extensive document and litigate the matter. The other 13 organizations signed the agreement.

Jordan and co-owner Denny Hamlin approached Nascar about potential amendments or negotiations. Nascar wasn’t talking, according to his testimony.

But in the end, the resistance against what he saw as a financially unsustainable model was mostly about the usual bottom line for Jordan: Winning.

“Hamlin persuaded me getting a third driver boosted our odds of winning,” he said, noting that he purchased another franchise last year for $28 million despite the uncertainty. “So I took the plunge.”

Account from the Gibbs Family

Gibbs described her request for permanent charters, submitted in a written letter to Nascar. She said the timing of the signature deadline was problematic.

She said, Joe Gibbs first tried to call and talk Nascar out of demanding signatures, but CEO Jim France declined the request.

“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s executives. She said France replied, “If I wake up and I have 20 charters, I have 20. If I have 30, that’s the number.”
